User Feedback Sessions Terms and Conditions

Scope

These Terms and Conditions set out the rules for user feedback sessions held by TravelPerk, S.L.U. (TravelPerk) to gather feedback on services offered or under development by the TravelPerk company group (Feedback Sessions).

In such case, the terms “You” and “Your” will refer to you in your capacity as a user or potential user of TravelPerk's products and services. If You do not have that authority, or if You do not agree with these Terms, You are not permitted to join Feedback Sessions.

These Terms and Conditions apply from the date that You accept them by submitting the session scheduling form or any other valid acceptance forms. TravelPerk reserves the right to update, revise or amend the Terms and Conditions at any time, in which case it will provide the Customer with reasonable prior notice and the updated Terms and Conditions from time to time.

These Terms and Conditions were last updated by the date indicated above.

Data Protection

TravelPerk hereby informs you that your personal data will be processed by TravelPerk as a data controller for the following purposes:

1. managing your participation in the relevant Feedback Session;
2. understanding user behaviours and needs;
3. gathering user feedback;
4. working on actionable insights for improvements; and
5. in case we have your consent, recording the session.

You may exercise your rights of access, rectification, erasure and portability, restriction, right to withdraw consent, and right to object to the processing through this form (choose the "I am a (an): TravelPerk tester" option).

TravelPerk will keep your personal data collected in Feedback Sessions for as long as these sessions are held, and while the conclusions obtained from the sessions are being studied and actioned. After that time, your data may also be retained for the applicable statutory retention periods in order to comply with legal obligations or for the period during which liabilities may arise from our relationship. TravelPerk maintains specific retention policies and procedures, so that such data is deleted or anonymized after a reasonable time and according to the statutory retention periods.

Intellectual Property and Confidentiality

Feedback Sessions may contain or display confidential, proprietary or legally privileged information (together, Confidential Information) from one of the parties (the Disclosing Party). All copyright, trademark, trade secrets and other intellectual property rights in the Confidential Information shall remain at all times the sole and exclusive property of the Disclosing Party and/or its third-party service providers and the other party (the Receiving Party) shall have no right or interest in the Confidential Information, or the information contained therein except for the right to manage or to participate in the Feedback Sessions as specified herein.

The Receiving Party acknowledges that the Confidential Information has been developed through the expenditure of substantial skill, time, effort and money. The Receiving Party will protect the Confidential Information of the Disclosing Party and/or its third-party service providers by not using it outside the scope of the relevant Feedback Sessions. The Receiving Party shall not publish, distribute, or otherwise make available to third parties any information derived from or relating to the Confidential Information, and will not copy, modify, de-compile, reverse engineer, and make derivative works of the Confidential Information or any information contained therein.

Recording of Feedback Sessions

Feedback Sessions may be recorded for internal use only to understand user behaviours and needs, gather user feedback and work on actionable insights for improvements.

You may grant your consent for the Feedback Session to be recorded prior to the start of the relevant sessions. You may also grant or withdraw it verbally once a statement to gather such consent has been read aloud by a TravelPerk team member prior to each Feedback Session, along with the relevant data protection information.

If you do not wish to authorise TravelPerk to record the sessions, you are free to do so. Under no circumstances will your refusal have any negative consequences for you.

Governing Law and Jurisdiction

These Terms and Conditions, and Feedback Sessions are governed by Spanish law. Any dispute arising, or any claim related to the content and services of this Platform shall be resolved by the courts of the city of Barcelona (Spain), and You expressly waive Your own forum or any other that may apply to You, to the extent permitted by Law.
